Website and Service Terms

Last updated October 13, 2026

These terms describe use of tarikzukic.com and the standard terms proposed for website services supplied by Tarik Zukic personally, as an individual based in Washington, United States. Visiting this page or sending an enquiry does not by itself form a paid project agreement. Service terms apply only when provided to you and expressly accepted as part of a written project agreement.

Prepared as a draft for review by a Washington-licensed attorney before reliance in a client engagement. These documents do not certify enforceability or replace legal advice.

Which document applies?

Different documents do different jobs. The order below resolves a conflict about a website project only when the documents were provided and accepted as part of that engagement. Sending an enquiry does not create an agreement.

Applicable mandatory law comes first. No document in this chart removes a right or duty that the law does not allow the parties to change.

  1. Signed amendments and accepted change orders

Use these to change a booked project: scope, price, dates or a particular obligation. Both parties must expressly accept the change in writing.

The most recent mutually accepted change controls only the provisions it expressly changes. It does not silently replace the rest of the agreement.

  2. Accepted project agreement or statement of work

Use this to book your specific project. It identifies the parties, deliverables, exclusions, price, milestones, payment schedule and handover.

It takes priority over the standard service terms only where it expressly states a different or overriding term. For example, a stated 30/40/30 payment schedule overrides the standard 50/50 schedule for that project.

  3. Website and Service Terms supplied at acceptance

Use these for the default rules on payment, cancellation, revisions, ownership, confidentiality and liability. Keep the version attached to the agreement.

These terms fill the gaps where the accepted agreement does not expressly provide a different rule. Later changes to this website do not rewrite an existing engagement.

  4. Website pricing, examples and enquiry messages

Use these to explore services and ask for a quote. Price ranges and examples help planning.

These are general information, not the final project scope, a binding price or an amendment. An expressly accepted written agreement is required to change project obligations.

Privacy follows the information

The Privacy Policy explains how I handle website visitors, enquiries and business/project information. It applies alongside the project documents, rather than sitting below them as a waiver. A separately accepted data-processing or confidentiality agreement may add project-specific protections and responsibilities. It cannot remove mandatory privacy rights, authorize an undisclosed incompatible use, or make inaccurate privacy statements acceptable. Ask me before sending customer personal data or sensitive records.

Written agreement and document priority

A project agreement consists of the expressly accepted proposal or statement of work, the version of these service terms supplied at acceptance, and mutually accepted written changes. The proposal must identify the parties, deliverables, exclusions, price, payment schedule, review process and estimated timeline. Applicable mandatory law always controls. A signed amendment or accepted change order takes priority only for the provisions it expressly changes. An accepted project agreement takes priority over these standard service terms only where it expressly states a different or overriding term. The remaining standard terms continue to apply. General website copy and enquiry messages do not override an accepted agreement.

Agreement confirmation means both parties sign the project agreement or expressly confirm its identified scope, price and attached terms by email. The person accepting for a business must have authority to bind it. An enquiry, quote request, informal conversation or website visit is not agreement confirmation. Keep a copy of the accepted version; later website edits do not amend an existing project.

50% upfront and remaining payment

Unless a different schedule is expressly agreed in the proposal, 50% of the total project price is due upon agreement confirmation. This is an advance credited toward the project price. A start date is reserved and work begins after the written agreement is confirmed, the advance has cleared and required materials and access have been supplied.

The remaining 50%, approved additions and any separately agreed expenses are due when the completed agreed deliverables are made available for final review and before public launch, production deployment, source-file handover or transfer of custom deliverable rights. An invoice will identify the amounts and due date. A genuine, timely reported material failure to meet the agreed scope must be addressed through the review and dispute process, rather than treated as automatic final acceptance.

Prices are in US dollars unless the proposal says otherwise. Taxes, third-party fees and recurring charges must be identified in the proposal or approved separately. There are no undisclosed charges. No late-payment interest or penalty applies unless separately agreed in writing and lawful.

Cancellation and no-refund policy

You may cancel by written notice. Payments for services already performed, completed approved milestones and authorized non-recoverable third-party costs are non-refundable merely because you change your mind, change plans, decide not to launch, or no longer need the work. This is not a money-back or satisfaction guarantee.

The upfront 50% is not automatically forfeited solely because it is called a deposit. On cancellation, I will provide a reasonable accounting of work performed and authorized committed costs against payments received. The proposal should allocate milestone values; otherwise, charges must reasonably reflect actual work within the accepted price and agreed expenses. Any unused advance exceeding amounts properly earned or owed will be returned. There is no additional cancellation or reservation penalty unless separately agreed and lawful.

If I cancel without your material breach, amounts for unperformed services are returned. Duplicate or mistaken payments are corrected. This policy does not exclude a refund, remedy, payment dispute or consumer right required by law, and does not excuse a material failure to supply the agreed services. Refunds that are due are processed promptly to the original payment method where practicable.

Scope and changes

Only the deliverables expressly listed in the accepted proposal are included. Extra pages, new features, additional design directions, integrations, content writing, migrations, additional revisions and work caused by changed instructions require an agreed written change identifying price and timeline before the additional work starts.

Online stores, checkout, payment processing and regulated-data systems are excluded from standard website packages. Billing or subscription integrations are included only if specifically agreed. Hosting, domains, paid plugins, fonts, stock assets and ongoing support are included only to the extent the proposal states.

Client materials and cooperation

You must supply timely, accurate content, approvals and authorized access; designate one decision-maker; consolidate feedback; and maintain backups of existing websites and business data. You confirm you have permission to use all supplied content, images, logos, trademarks, data and software.

Do not send passwords in the contact form. Use delegated accounts or an agreed secure method with the minimum access needed. You remain responsible for business claims, pricing, offers and the lawful basis for the personal information you supply. I remain responsible for my own agreed work and obligations; this allocation does not excuse unlawful conduct by either party.

Reviews and revisions

Unless the proposal says otherwise, the price includes two consolidated rounds of revisions within the agreed design and build scope. A round is one complete feedback list from your decision-maker. A new concept, changed brief or new feature is a scope change, not a correction.

Please provide acceptance or a specific list of material departures from the agreed scope within 10 business days of a review delivery. I will address verified in-scope defects and resubmit. No response allows scheduling to be adjusted and the project to be paused after notice; silence alone does not create a new contract, waive mandatory rights or automatically approve a defective deliverable.

Scheduling and inactivity

Timeline estimates depend on prompt content, access, approvals and payments. Client delays, approved scope changes and events outside reasonable control may move delivery dates. I will communicate material changes. A fixed deadline or service-level commitment applies only if expressly agreed.

If required feedback, access or an undisputed payment is missing, I may pause work after written notice and a reasonable opportunity to resolve it. After 30 days of inactivity, I may close the active schedule after a further seven-day notice and account for work under the cancellation policy. Restart timing and any genuinely additional work require written agreement; there is no automatic forfeiture or surprise restart fee.

Launch and final handover

Launch requires your express written approval of the final content and deliverables, payment of amounts properly due, and the required domain and hosting access. Review previews are provided for evaluation and do not authorize copying, public use or deployment of unpaid custom work.

Your existing accounts, domains and pre-existing property remain yours. I will not hold unrelated client assets hostage for a payment dispute. After payment, handover covers the files, access and documentation promised in the proposal; indefinite file storage and unlimited training are not included.

Ownership and licenses

You retain rights in material you supply. Subject to full payment, I assign my rights in the bespoke final deliverables expressly identified for transfer in the signed project agreement. An actual copyright assignment must be documented in writing and signed by the rights owner. Drafts, rejected concepts and unpaid work are not transferred.

I retain pre-existing code, reusable components, templates, utilities, know-how and development tools. To the extent these are embedded in a paid final deliverable, you receive a perpetual, worldwide, non-exclusive license to use and modify them as part of that deliverable, including through a replacement developer. Third-party and open-source materials remain subject to their own licenses; no greater rights can be transferred than I hold.

Portfolio display of your name, logo, screenshots or case study requires permission, except where expressly authorized in the signed proposal. Confidential information is not used in public examples without your approval.

Confidentiality and project data

Each party will use the other's non-public project information only for the engagement, protect it with reasonable care and share it only with people or providers who need it and are bound by appropriate duties. This does not cover information already public without breach, independently developed, lawfully received from another source or legally required to be disclosed.

Processing customers' personal data, confidential production data or regulated records requires a separate agreed scope and appropriate data-processing/security terms. Do not put sensitive records in the preview portal. Any use of subcontractors or AI services with confidential client material must comply with the agreement and approved data-handling arrangements.

Third-party services and ongoing care

You generally contract directly with domain, hosting, booking, email, analytics and payment providers. Their fees, uptime, terms and changes are outside my control. I will identify dependencies relevant to the agreed work; I do not guarantee a provider's continued availability or assume its contractual duties.

Updates, backups, monitoring and security maintenance after delivery require an expressly agreed care plan. If a monthly plan is agreed without different cancellation terms, you may stop future renewals by notice before the next billing date. Earned services for a period already provided are not refunded for a change of mind; prepaid unperformed services are accounted for under the cancellation policy. No automatic renewal is authorized by merely visiting this website.

Defect corrections and limits of promises

For 30 calendar days after agreed handover, I will correct reported, reproducible defects in my work that materially depart from the accepted scope without an additional fee. This covers corrections, not added features, changed instructions, third-party outages or problems caused by changes made by others. Mandatory rights and expressly agreed warranties may extend beyond this period.

I will perform the agreed work with reasonable care and skill. I do not promise particular sales, enquiries, search rankings, indexing, accessibility certification, uninterrupted service or freedom from every security issue. Accessibility testing, browser support, performance targets and compliance deliverables must be defined in the proposal. These limits do not remove a legal obligation that cannot be excluded.

Liability limits

To the maximum extent permitted by applicable law, neither party is liable to the other for indirect or consequential losses arising from a project, including lost profits, lost business opportunities or loss caused by independent third-party services. For an ordinary project claim, my aggregate liability is limited to the fees actually paid to me under the affected project agreement.

These exclusions and the cap do not apply to fraud, willful misconduct, gross negligence, amounts that must be refunded, or any liability or remedy that applicable law does not permit to be limited. They do not eliminate your obligation to pay amounts properly earned. Where a provision is unenforceable, the lawful remainder applies; no clause guarantees protection from a lawsuit.

Client-supplied material claims

For business engagements, to the extent permitted by law, you will defend and indemnify me against third-party claims arising from material you supplied without the necessary rights, or your unlawful instructions, including reasonable resulting costs. This does not cover claims caused by my own breach, negligence or misconduct.

The party requesting protection must give prompt notice and reasonable cooperation. No settlement may admit fault, impose an obligation on the protected party or compromise its rights without written consent. Consumer protections remain unaffected.

Disputes and Washington law

If there is a dispute, first send a written explanation and requested resolution to infozukic5@gmail.com. We will attempt in good faith to resolve it within 30 days. This discussion requirement does not prevent urgent relief, a timely small-claims filing, a statutory complaint or action needed to preserve a deadline.

Washington law governs to the extent permitted by applicable law. Disputes may be brought in a competent Washington state or federal court unless mandatory law gives a different right or venue. These terms do not require arbitration, waive a jury or class-action right, or prevent a lawful payment dispute. Neither party is entitled to contractual attorney fees solely under these terms; statutory rights remain.

Use of this website

The website provides general service information and portfolio samples. Displayed price ranges are estimates, not a binding offer. Concepts and development projects are identified as such and are not representations of completed client work. Separate app terms, store policies and third-party privacy notices apply to linked products.

Do not disrupt the website, attempt unauthorized access, impersonate someone, infringe rights, scrape private previews or submit unlawful material. Website text, design and artwork may not be republished without permission except as permitted by law. To the extent permitted by law, the informational website is supplied as available without a promise of uninterrupted or error-free access.

General provisions and contact

Changes to an existing engagement require mutual written agreement. Electronic signatures and expressly confirmed email agreements may be used where legally valid; merely linking to terms after agreement does not show prior acceptance. The accepted agreement and its written amendments contain the project terms. If one provision is invalid, the others remain effective to the lawful extent.

For questions about these terms, document priority, a project, a cancellation or a dispute, contact Tarik Zukic at infozukic5@gmail.com before proceeding if anything is unclear.
